Power of Attorney for Property — When and How to Use It

What is a Property PoA?

A Power of Attorney (PoA) is a legal document authorising a person (attorney/agent) to act on your behalf for property transactions. Used by NRIs, elderly owners, and buyers transferring ownership remotely.

General PoA vs. Special PoA

General PoA: broad powers to manage all property matters. Special PoA: specific to one transaction (safer). For property sales, always use Special PoA to limit the attorney's authority.

Is a PoA Sale Valid?

The Supreme Court (Suraj Lamp & Industries, 2011) ruled that PoA sales are NOT valid substitutes for proper sale deeds. A PoA can help with paperwork but ownership transfer requires a registered sale deed in your name.

Executing a PoA Abroad

NRIs must execute PoA before an Indian consulate or notarised by a local notary, then apostilled. The PoA must reach India within 3 months and be registered with a sub-registrar if dealing with immovable property.

Revoking a PoA

A PoA can be revoked by the grantor at any time if it is not coupled with an interest. Send a registered notice to the attorney and update the sub-registrar who originally registered it.
